Poland Payroll & Employment Guide
This guide is for employers setting up a company in Poland, opening a branch, or moving an existing team into the country. It is a reference for HR, payroll and finance teams in day to day decisions. Poland is an EU member, so EU, EEA and Swiss citizens move freely under free movement rights and need no work permit. Third country nationals instead fall under five separate permit types plus the combined residence and work permit regime, zezwolenie jednolite. 2026 brought change on three separate fronts in Polish payroll. The public holiday count is not 13 but 14, because Wigilia, 24 December, became a statutory holiday from 2025 and the older "13 holidays" assumption no longer holds. The KSeF e invoicing mandate is rolling out in three phases, large taxpayers were already in scope from 1 February 2026, every other VAT payer joins on 1 April 2026, and the smallest taxpayers join on 1 January 2027. The special employment regime for Ukrainian staff was not simply extended, it ended completely on 4 March 2026 and was restructured from 5 March 2026 under the general law on protection for foreigners, with "temporary protection (UKR)" status guaranteed through 4 March 2027. A payroll setup built on the prior year's parameters produces wrong results in 2026.

Setting Up and Doing Business
Legal form choice, KRS registration and the KSeF e invoicing calendar.
The overwhelming majority of foreign investors in Poland set up a sp. z o.o., the local equivalent of an LLC, and a single member sp. z o.o. is possible. The S.A., a joint stock company, requires heavier corporate governance and carries a minimum capital requirement. A branch, oddział, is not a separate legal entity, it uses the parent company's capital and binds the parent directly. A representative office, przedstawicielstwo, can only run marketing and promotion activity and cannot generate revenue.
Working Conditions and Leave
Working time, leave entitlements and the 2026 holiday count correction.
Under Kodeks pracy (KP) articles 129 and 130, standard working time is 8 hours a day and an average of 40 hours a week, with a reference period of up to 4 months, extendable to 12 months for objective or technical reasons. The default annual overtime cap is 150 hours, which can be raised by collective agreement or work regulations, and there is no fixed statutory ceiling. As of 2026 the public holiday count is 14, because Wigilia, 24 December, became a statutory holiday from 2025, and the "13 holidays" assumption still seen in some guides no longer holds.
Tax and Social Security
Income tax bands, ZUS contribution rates and the contribution base cap.
Poland's social security equivalent body is ZUS, Zakład Ubezpieczeń Społecznych. Income tax has two bands, up to PLN 120,000 at 12%, and above that PLN 10,800 plus 32% of the excess. The annual tax free amount is PLN 30,000 and has not changed since 2022, and income above PLN 1,000,000 carries an additional 4% solidarity levy. The floor that actually sets Polish payroll is the 2026 minimum wage of PLN 4,806 a month gross.
Payroll Operations
Payment cycle, the digital filing platform and foreign worker certificates.
Under KP article 85, wages are paid at least once a month, on a fixed, predetermined date, and no later than the 10th day of the following month. The default payment method is a bank transfer, and cash payment is only possible at the employee's written request. Poland has no general obligation to issue a pay slip, the only statutory duty is to make the calculation records available for inspection on request.
Hiring and Termination
Probation, notice periods and the severance pay cap.
Employers must register an employee with ZUS within 7 calendar days of the start of employment, using form ZUS ZUA or ZUS ZZA. The probation period is capped at 3 months by default, shortened to 1 or 2 months depending on the length of the following planned contract, and can be extended once by up to 1 month. From 26 April 2023 the exception that allowed a new probation period for the same employee in the same type of work after 3 years was removed, a new probation period is now only possible for a different type of work.
Compensation and Benefits
The 13th salary, PPK contributions and tax exempt benefits.
There is no statutory obligation for a 13th salary in the private sector, it is paid only by custom, collective agreement or internal policy. In the public sector a mandatory additional payment equal to 8.5% of annual pay applies, subject to a full year or at least 6 months of work. Under PPK, the employee pension scheme, the mandatory employer contribution is 1.5%, optionally raisable to up to 2.5%.
Visas and Work Permits
Free movement, permit types and Ukraine's restructured 2026 regime.
Poland is an EU member, so EU, EEA and Swiss citizens have free movement rights and need no work permit, though stays beyond 3 months require residence registration with the voivode. Third country nationals fall under five permit types, A through E, plus the combined residence and work permit regime, zezwolenie jednolite, with authority sitting with the Voivodeship Office. The special employment regime for Ukrainian nationals was fundamentally restructured in 2026, Poland's most distinctive 2026 development.
Practical Notes
Contract disclosures, the 3/33 rule and cross border payments.
The basic terms of a written employment contract must be disclosed before work starts, a breach carries a fine of PLN 1,000 to PLN 30,000. In addition, as a separate obligation introduced by the 2023 act, further information must be provided within 7 days of the start of work. The most commonly missed point on fixed-term contracts is that the 3/33 rule carries a count limit as well as a duration limit, a third contract with the same employer can breach the limit even before the cumulative duration runs out.
Incentives and Employer Support Schemes
The PFRON subsidy, the KFS training fund and what does not exist.
The standard employer burden is the ZUS contributions covered in Section III plus the Fundusz Pracy and FGŚP contributions. The mechanisms below reduce that baseline for targeted categories, Poland has no general, permanent relief system comparable to Turkey's social security incentive catalogue.
This guide is for general information only; it is not legal advice or a complete statement of the law. The content reflects the legislation in force when it was prepared, and legislation changes. Always take country-specific professional advice on a concrete case.
With Datassist
Managing Polish Payroll
Polish payroll is not a structure that can be built by reading a single piece of legislation. Tracking the 33 month and 3 contract limit on fixed-term employment, correctly calculating a ZUS contribution structure with age and parental return exemptions, keeping pace with a KSeF e invoicing mandate rolling out in three phases through 2027, and following the temporary protection regime for Ukrainian staff that was fully restructured in March 2026 are four connected disciplines. Datassist runs all four layers as a single operation for employers with staff in Poland and reconciles the parameters against official sources in every payroll period. For companies still at the setup stage, it plans the path from choosing a legal form to the first ZUS employer registration within the same framework.
