Belgium Payroll & Employment Guide

This guide is for employers setting up a company in Belgium, opening a branch, or moving an existing team into the country. It is a reference for HR, payroll and finance teams in day to day decisions. The pay and leave rules applied in Belgium cannot be verified from national statute alone, so each section shows the statutory floor and the sector joint committee layer separately. 2026 is the point where several Belgian reforms taking effect in the same year intersect. Notice periods changed under two separate acts, the classic probation period effectively returned, the flexi job regime opened to every sector, the voluntary overtime system was rebuilt, and the retirement age rose. Each of these applies a different regime depending on the contract start date. A payroll setup built on the prior year's parameters produces wrong results in 2026.

Setting Up and Doing Business

Legal form choice, registration steps and the lending prohibition.

The structure most used by foreign investors in Belgium is the BV/SRL. The 2019 reform of company law removed the minimum capital requirement for this form. The NV/SA requires heavier corporate governance and remains the only Belgian form that keeps a minimum capital rule. A branch can also be opened without forming a separate legal entity. A branch is not a separate legal entity and binds the parent company abroad directly.

Working Conditions and Leave Entitlements

Working time, leave and incapacity rules.

Statutory maximum working time is 8 hours a day and 38 hours a week. Some joint committees lower this to between 35 and 37 hours. Daily rest is 11 hours and weekly rest is 24 hours, as a rule falling on Sunday. Leave, overtime premiums and sick pay top ups can be raised above the statutory floor by the sector joint committee. Leave entitlement accrues based on time worked in the prior calendar year rather than the current year.

Tax and Social Security

Income tax, the joint committee pay floor and contribution rates.

Income tax is progressive, with federal bands plus a municipal surcharge of between 0% and 9%. Monthly withholding is an advance, and the annual return sets final tax. The floor that actually sets Belgian payroll is not the national RMMMG but the pay scale of the sector joint committee the employer belongs to. The RMMMG binds only a small share of the workforce directly.

Payroll Operations

Payment cycles, pay slips and the Dimona and DmfA filings.

White collar employees are paid at least once a month, and blue collar employees at least twice a month with no more than 16 days between payments. Belgian payroll runs on two separate mandatory digital platforms. Dimona is the event based start and end of employment filing, and DmfA is the quarterly wage declaration. Neither replaces the other.

Hiring and Termination

Contract types, probation, notice and the 2026 notice reform.

The open ended contract is standard, the fixed term contract is the exception. The student contract, available for up to 650 hours at a reduced regime, and the flexi job, open to every sector from 1 July 2026, are separate statuses. Notice periods changed under two separate acts in 2026. Which regime applies depends on the contract start date, and existing contracts stay under the old regime.

Compensation and Benefits

Pay floor, double holiday pay and benefit obligations.

The minimum wage actually owed to an employee is not the national RMMMG but the pay scale of the employer's own joint committee. The 13th month bonus is not a statutory obligation in Belgium. Its existence and amount depend entirely on the sector agreement or company custom, the common reference value is one month's gross pay, and it is taxed under the exceptional payment scale.

Visas and Work Permits

Free movement, the single permit regime and posting from Turkey.

Citizens of the EU, the EEA and Switzerland move freely and need no work permit. For third country nationals the single permit regime has applied since the 2014 sixth state reform. Authority over work permits has been devolved to the regions, Flanders, Wallonia and Brussels, while the residence decision remains with the federal DOFI. Turkish nationals fall under the third country regime.

Practical Notes and Common Pitfalls

Common mistakes and headcount based obligations.

The three most common mistakes made by foreign employers are these. treating gross pay as the total employer cost, assuming the RMMMG is the effective pay floor, and filing Dimona too late. Once employer contributions, the meal voucher share, group insurance and double holiday pay are added, the true employer cost typically reaches 1.4 to 1.5 times gross pay.

Incentives and Employer Support Schemes

2026 regional support and conditional incentives.

The reference baseline for the incentive delta is this. employer social security runs about 27% for white collar staff and 33% for blue collar staff. Target group reductions have been regionalised since the 2014 reform. Each region runs its own programme through its own agency, and the national structural reduction does not cover every employee.

This guide is for general information only; it is not legal advice or a complete statement of the law. The content reflects the legislation in force when it was prepared, and legislation changes. Always take country-specific professional advice on a concrete case.

With Datassist

Managing Belgian Payroll

Belgian payroll is not a structure that can be built by reading a single national statute. Identifying the correct sector joint committee, applying the 2026 double notice reform according to each contract's start date, running the Dimona and DmfA filings as separate streams, and tracking regional incentives are four connected disciplines. Datassist runs all four layers as a single operation for employers with staff in Belgium and reconciles the parameters against official sources in every payroll period. For companies still at the setup stage, it plans the path from choosing a legal form to filing the first Dimona notification within the same framework.
