Luxembourg Payroll & Employment Guide

This guide is for employers setting up a company, opening a branch, or moving an existing team into Luxembourg. Luxembourg is a founding member of the European Union and hosts several of its core institutions, so free movement applies to EU and EEA nationals and the immigration burden falls mainly on third country nationals. The guide is built as a reference HR, payroll and finance teams can use in day to day decisions. The defining structural feature of Luxembourg payroll in 2026 is automatic wage indexation, known in French as échelle mobile des salaires. Once the national consumer price index calculated by STATEC crosses a set threshold, every wage element, base pay and allowances alike, is updated immediately and automatically. This is not an annual review cycle, and because it is a matter of public order it cannot be lowered even by collective agreement. The most recent tranche was triggered on 1 June 2026, moving the index from 968.04 to 992.24, a rise of 2.5%. The date of the next tranche has not yet been fixed by STATEC. A payroll engine therefore has to watch for the triggered tranche rather than assume a fixed annual raise date.

The opening summary of each chapter is below. Full text, tables and rates are in the PDF.

Setting Up and Doing Business

Legal forms, minimum capital and employer registration.

Foreign investors most often use SARL, SA, SCA or SARL-S as the capital company form in Luxembourg. A succursale, or branch, can be opened without forming a separate legal entity, and a branch is not a separate legal person. A bill for a mandatory domestic B2B e-invoicing regime was submitted to Parliament in 2026, it has not yet become law, and it will come into force no earlier than 2028.

Working Conditions and Leave

Working time, annual leave, maternity and sick pay.

The Code du travail sets statutory normal working time at 8 hours a day and 40 hours a week, with a maximum including overtime of 10 hours a day and 48 hours a week. Leave and allowances carry a tiered structure, and the full public holiday list could not be individually confirmed from a primary source in this session.

Tax and Social Security

Income tax bands and CCSS contribution rates.

Income tax is calculated across three tax classes, on a 23 bracket scale from 0% to 42%, and is withheld monthly at source through the RTS mechanism. Social security contributions follow CCSS's branch by branch rates, with a floor equal to SSM and a ceiling of 5 times SSM.

Payroll Operations

Wage indexation, monthly reporting and record retention.

The payroll cycle is shaped by Luxembourg's defining feature, automatic wage indexation. Once the index calculated by STATEC crosses a threshold, every wage element, base pay and allowances alike, is updated immediately and automatically. This is not an annual review, and because it is a matter of public order it cannot be lowered even by collective agreement. A payroll engine therefore has to watch for the triggered tranche rather than assume a fixed annual raise date.

Hiring and Termination

Probation, notice periods and severance pay.

The probationary period can be freely set by the parties between 2 weeks and 6 months, rising to a maximum of 3 months for employees below the CATP skill level and to a maximum of 12 months for employees above a given pay threshold. Notice periods and severance pay follow a tiered structure.

Compensation and Benefits

SSM bands, the 13th month custom and meal vouchers.

Luxembourg has no classic annual mandatory pay increase obligation, but automatic wage indexation functionally fills that role, raising every wage element by the same percentage at each triggered tranche. SSM is tiered by age and skill level.

Visas and Work Permits

EU free movement, the EU Blue Card and posting of workers.

Luxembourg is a full member of the EU and the EEA, so EU, EEA and Swiss nationals can work freely without a work permit. The immigration burden falls mainly on third country nationals, and the EU Blue Card threshold was raised again in 2026.

Practical Notes

The most commonly confused points and the disability quota.

The two points a foreign employer most often confuses on Luxembourg payroll are reading wage indexation as an annual raise, and copying Belgium's regional language regime into Luxembourg. Each rests on a different legal basis.

Incentives and Employer Support Schemes

ADEM programmes and short-time work support.

As a baseline for comparison, the standard employer social security burden is between 12.32% and 15% of gross pay. Luxembourg has no Gulf style national employment quota, Luxembourg is an EU member, and there is no general, permanent employer social security exemption applying to all employers for a first hire. Existing support instead takes the form of targeted schemes.

This guide is for general information only; it is not legal advice or a complete statement of the law. The content reflects the legislation in force when it was prepared, and legislation changes. Always take country-specific professional advice on a concrete case.

With Datassist

Running Luxembourg Payroll

An automatic wage indexation mechanism that resets pay bands outside any annual review cycle, a CCSS monthly declaration and 8-day event-reporting duty, no statutory 13th month despite near-universal custom, and an EU Blue Card threshold raised again in March 2026 all have to run on one compliant calendar. Datassist helps international employers manage Luxembourg payroll and employment processes from a single center.
