Azerbaijan Payroll & Employment Guide
This guide is for employers engaging staff through an Azerbaijani entity or managing Azerbaijani payroll within a multi-country operation. It reflects general private-sector rules as of October 26, 2026. Oil and gas activity, public-sector status, employee category, collective agreements and the foreign-worker permit route can change the result.

The opening summary of each chapter is below. Full text, tables and rates are in the PDF.
Company Formation and Business Environment
Employer structure, registrations and the contract layer.
Foreign investors frequently use a məhdud məsuliyyətli cəmiyyət, or MMC/LLC. There is no general minimum capital amount. After registration, the tax, bank, social-insurance and electronic employment-contract permissions should be established as separate operating workflows.
Working Conditions and Leave Entitlements
Working time, leave and periodic payment rules.
Working time, overtime and leave entitlements should be reconciled between payroll and time records. Overtime cannot be replaced with additional leave. Night-work premiums and conditional leave or benefit requirements must be checked separately.
Tax and Social Security
Income tax, contributions and social security parameters.
In 2026, employees in the private, non-state and non-oil-and-gas sector use a separate income-tax schedule. The general schedule applies to public, oil and gas, or other employers outside the special schedule.
Payroll Operations
Payroll calendar, filings and record obligations.
At least 1 salary payment is made each month. By mutual agreement, 2 payments can be made each month with no more than 16 days between them. An employment contract, amendment or termination takes legal effect when its notice is registered in the ƏMAS electronic system with a qualified electronic signature.
Hiring and Termination
Onboarding, contracts, notice and termination controls.
An employment contract takes effect on ƏMAS registration. Allowing work before electronic notification is subject to sanction. Probation is capped at 3 months. A fixed-term contract based on an objective reason can generally run for up to 5 years.
Wages and Benefits
Pay floors, additional payments and benefits.
Base pay for the full monthly working norm may not be below AZN 400. No general automatic annual private-sector pay increase or statutory 13th salary was verified. These payments can arise from an individual contract, collective agreement or employer policy.
Visas and Work Permits
Local hiring, foreign workers and mobility rules.
A foreign national generally needs a work permit for paid activity. The test requires that no suitable local candidate is available and that the employment service cannot meet the need from domestic labor resources.
Practical Notes and Compliance Risks
Controls before first payroll and throughout the operation.
The main payroll risk in Azerbaijan is inconsistent employee or salary data across the ƏMAS contract, payroll master data, bank file and unified return. Onboarding, salary changes and termination should follow one approval sequence.
Incentives and Employer Support Schemes
2026 employer support and conditional incentive schemes.
Azerbaijan's employment support operates through targeted wage co-financing, eligible jobs above the quota and vocational training rather than one general contribution reduction. Eligibility should be confirmed with the State Employment Agency before an application.
This guide is for general information only; it is not legal advice or a complete statement of the law. The content reflects the legislation in force when it was prepared, and legislation changes. Always take country-specific professional advice on a concrete case.
